IncSmart Idaho (Small Business and Startups) - Idaho has strengthened its noncompete law to protect employers. Many states such as Utah, have passed legislation to restrict noncompete agreements and California goes so far to prohibit noncompete agreements entirely. This new law says now companies can protect their assets in a competitive marketplace. However, the new entrepreneurs are not in favor of the law at all. They are finding it difficult to hire people if they are unable to leave jobs for higher pay.
Idaho businesses will now have an easier time enforcing noncompete agreements that restrict key employees and independent contractors from applying for post-employment jobs. This new bill passed by the Idaho legislature, and the law stated March 2, 2017. When a court finds that a key employee or key independent contractor breach it's contract, a rebuttable presumption of irreparable harm is established. The burden of overcoming that presumption shifts to the former employee. They must now show that they have no ability to adversely affect the previous employer.
