DEFINITION
An affidavit is a written sworn statement of fact voluntarily made by an affiant or deponent under an oath. An affidavit is not the same as a deposition. The Affidavit is witnessed by an authority such as a Notary Public. Can serve as evidence in court proceedings. The Affidavit is not the same as deposition. Depositions questions are asked by an attorney with a court recorder present.
